Terms of Service

1. The service

MyVitrina builds websites for businesses with the help of artificial intelligence, publishes them on a myvitrina.dev subdomain or a custom domain, and lets you edit them from the dashboard. Some plans include an online store with payments through Stripe.

We may change, improve or discontinue any feature. If a change materially affects a paid plan, we will notify you by email with reasonable notice.

2. Your account

You need an account with a valid email to use the dashboard. You must be at least 18 and legally able to accept these terms.

You are responsible for everything done with your account and for keeping access to your email secure.

3. Plans, payments and cancellation

The free plan lets you generate and preview sites, but not publish them. Paid plans are billed monthly or yearly, in advance, through Stripe, and renew automatically until cancelled. Prices are those shown on the pricing page at checkout, plus applicable taxes.

You can cancel anytime from "My account". Your plan stays active until the end of the period already paid and you will not be charged again. There are no refunds for partial periods, except where required by law.

If a payment fails or a plan is cancelled, sites above the resulting plan’s limit are unpublished. Their content is not deleted and can be published again when a plan is reactivated.

Each plan includes a number of AI edits per month. Unused edits roll over up to twice the monthly amount. They have no cash value and are not refundable.

4. Domains

Domains bought through MyVitrina are registered in your name through our registrar partner, using the contact details you provide. They are billed yearly and renewal depends on keeping payment current. Each extension (.com, .net, etc.) is subject to its registry’s rules.

5. Online store

Store sales are processed through a Stripe account connected in the site owner’s name, who also accepts Stripe’s terms. MyVitrina is not a party to those sales.

The site owner is solely responsible for their products, prices, shipping, returns, taxes and customer service.

6. Your content

The text, photos, logos and data you upload or generate for a site belong to you. You grant MyVitrina a limited license to store, process, display and publish that content in order to provide the service.

You confirm that you have the right to use what you upload and that your site does not infringe third-party rights or applicable laws.

7. AI-generated content

AI-generated text may contain errors or details that do not match your business (for example prices, hours or services). Review it before publishing. You are responsible for what you publish on your site.

Sample photos come from Unsplash and are used under its license.

8. Acceptable use

You may not use MyVitrina for: illegal activities; selling prohibited or regulated goods without authorization; misleading, fraudulent, hateful or sexually explicit content; phishing or malware; spam; infringing copyrights or trademarks; or attempting to harm, overload or gain unauthorized access to the service.

If these terms are breached, we may unpublish the site or suspend the account. Except in serious or urgent cases, we will notify you by email first.

9. Copyright (DMCA)

If you believe a site published with MyVitrina infringes your copyright, email mdgdevelop@gmail.com with: your contact details, the work affected, the exact address of the content, a good-faith statement and your signature. We will review the notice and remove the content when appropriate.

10. MyVitrina’s property

The software, templates, design and MyVitrina brand belong to mdgdevelop software solutions LLC. These terms grant no rights in them other than use of the service.

11. Warranties and liability

The service is provided "as is" and "as available". We make reasonable efforts to keep it running, but do not guarantee it will always be available or error-free.

To the extent permitted by law, MyVitrina is not liable for indirect damages, lost profits, or loss of data or sales. MyVitrina’s total liability is limited to the amount you paid in the 12 months before the claim.

You agree to indemnify MyVitrina against third-party claims arising from your site’s content or your store’s sales.

12. Closing your account

You can ask us to close your account and delete your data by emailing mdgdevelop@gmail.com. Once closed, your sites are unpublished.

13. Governing law

These terms are governed by the laws of the State of North Carolina, USA. Any dispute will be resolved in the courts of that state, unless consumer law provides otherwise.

14. Changes to these terms

If these terms change, we will update the date above and, for material changes, notify you by email. Continuing to use the service after a change means you accept it.
